Accessibility Sanctions 2025-2026: Amounts, Procedures, Case Law, and Enforcement

2025-2026: The Sanctions Turning Point

The 2025-2026 period marks a turning point with the EAA enforcement and strengthened controls by Arcom and DGCCRF.

RGAA Sanctions (Public Sector)

€20,000 per year per online service for missing accessibility statements or multi-year plans. Arcom can issue formal notices, verify publication, and conduct on-site and online inspections.

EAA Sanctions (Private Sector)

DGCCRF enforcement includes proportional administrative fines, compliance injunctions, market withdrawal for non-compliant products, and possible publication of sanctions. Consumer and disability associations can bring collective legal actions.

Strengthened Controls 2025-2026

Arcom announced reinforced control plans, DGCCRF integrates accessibility in annual control plans, and disability associations are increasingly active in reporting.

Protection Against Sanctions

  1. Publish an accessibility statement (transparency reduces risk)
  2. Publish a multi-year plan (demonstrates commitment)
  3. Document your efforts (audits, corrections, training)
  4. Implement a reporting mechanism
  5. Fix critical non-conformities
  6. Use RGAA Test for regular compliance monitoring
Sanctions are no longer theoretical. With Arcom and DGCCRF mobilized, controls are real and fines will be applied. The best protection is proactive compliance.
€20,000 per year per online service for missing accessibility statement or multi-year plan. An organization with a website and app without statement or plan risks up to €80,000 per year (2 services × 2 missing items × €20,000).
Arcom controls the public sector (RGAA). DGCCRF controls the private sector (EAA). The Defender of Rights can be contacted for discrimination. Disability and consumer associations can bring legal actions.
The first effective sanctions are being issued in 2025-2026. The Defender of Rights has issued recommendations. Arcom has issued formal notices. Case law is still limited in France, but the number of controls is increasing significantly.
